4. How We Respond

Upon receiving a valid DMCA notice, ImagArt AI will take the following actions:

1. Verify the notice for completeness and legal sufficiency
2. Remove or disable access to the allegedly infringing material
3. Notify the affected user of the removal and provide information about counter-notice procedures
4. Preserve evidence for potential legal proceedings
5. Follow all legal requirements under 17 U.S.C. § 512

Response time: We aim to respond to complete, valid DMCA notices within 5 business days.

5. Counter-Notice Procedure

If your content was removed following a DMCA notice and you believe the removal was erroneous or wrongful, you may submit a counter-notice. A valid counter-notice must include:

1. Your name, address, phone number, and email address
2. Identification of the material that was removed and its location before removal
3. A statement under penalty of perjury that you have a good-faith belief that the removal was erroneous
4. Your statement that you consent to the jurisdiction of the federal courts in your location (or, if you are outside the U.S., that you consent to jurisdiction in any federal court)

ImagArt AI prohibits the following:

• Circumventing technological protection measures

8. Safe Harbor Protection

• Not receiving direct financial benefit from infringement

9. Non-Infringing Use

Nothing in this policy prevents the legitimate, non-infringing use of copyrighted material under fair use or other applicable doctrines. If you believe your use qualifies as fair use or another legal exception, you may include this argument in a counter-notice.
