4. Intellectual Property
ImagArt AI Ownership: We own all intellectual property in our platform, algorithms, design, brand materials, and proprietary technology.
Your Ownership: You retain ownership of generated images and any content you upload, subject to the license rights you grant to ImagArt AI.
5. Prohibited Conduct
You agree NOT to:
- ✗ Create illegal content
- ✗ Harass, threaten, or abuse others
- ✗ Create hate speech or discriminatory content
- ✗ Generate violent or graphic material
- ✗ Create sexually explicit content (except legitimate adult-oriented uses)
- ✗ Infringe copyrights or intellectual property
- ✗ Create deceptive deepfakes or misleading content
- ✗ Interfere with platform systems or security
- ✗ Attempt unauthorized access to systems
- ✗ Use the Service for spam or bulk automated operations
Violations may result in account suspension or termination.
6. Account Responsibility
You are responsible for:
- Providing accurate account information
- Maintaining password confidentiality
- Preventing unauthorized access to your account
- Notifying us immediately of security breaches
We are not liable for unauthorized access if you fail to maintain reasonable security.
7. Content Policies
Content you generate must:
- ✓ Be original or properly licensed
- ✓ Not violate third-party intellectual property
- ✓ Comply with all applicable laws
- ✓ Not be deceptive or fraudulent
- ✓ Not promote violence, hatred, or harm
Strictly Prohibited Content:
- Child safety violations
- Non-consensual intimate imagery
- Violence and harm instructions
- Hate speech and discrimination
- Malicious hacking tools
Violations result in content removal, warnings, suspension, or termination.
8. Premium Subscriptions
Subscription Terms:
- Subscriptions renew automatically
- You authorize recurring charges to your payment method
- Cancellation requires explicit action in your account settings
- Non-cancellation results in automatic renewal at the next billing cycle
- Confirmation emails precede each charge
Refund Policy:
- Full refund within 30 days if unsatisfied with the Service
- No refund for generated images already downloaded
- After 30 days: Plan cancels at the next billing cycle end
- No penalties or hidden fees
9. "AS-IS" Disclaimer
The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied:
- ✗ Warranties of merchantability or fitness for a particular purpose
- ✗ Warranties that the Service is error-free or uninterrupted
- ✗ Warranties that defects will be corrected
- ✗ Warranties about AI output accuracy or originality
If the Service doesn't meet your needs, your sole remedy is discontinuation of use.
10. Limitation of Liability
In no event shall ImagArt AI be liable for:
- Direct, indirect, or consequential damages
- Loss of profits, revenue, or data
- Business interruption or reputational harm
- Damages exceeding the amounts you paid in the past 12 months
- Any damages resulting from your use of the generated content
Even if we've been advised of such damages' possibility, we are not liable.
11. Indemnification
You agree to indemnify and hold harmless ImagArt AI, its officers, employees, and agents from:
- Claims arising from your use of the Service
- Your violation of these Terms
- Your violation of applicable laws
- Your generated content or claims related to it
- Copyright infringement claims
- Third-party claims related to your conduct
This includes attorney fees and legal costs.

- We are not responsible for third-party policies or conduct
- Do not endorse third-party products or services
- Are not liable for third-party conduct or content

Venue & Jurisdiction:
You agree to exclusive jurisdiction and venue in courts located in Algiers, Algeria.
Dispute Process:

- If unresolved, parties may pursue mediation
- Final disputes are resolved through the courts of competent jurisdiction
Class Action Waiver:
You agree not to bring class action or representative actions. All disputes must be resolved individually.
16. Severability
If any provision is invalid or unenforceable, it is modified to the minimum necessary extent or severed. The remaining provisions remain in full effect.
17. Entire Agreement
These Terms, along with the Privacy Policy, Cookies Policy, DMCA Policy, Copyright Policy, and other referenced policies, constitute the entire agreement regarding the Service and supersede all prior understandings.
